Welcome to Harshit Web Solutions. By accessing our website and utilizing our services (Web Development, Ecommerce Setup, Amazon/Flipkart Seller Management, etc.), you agree to comply with and be bound by the following terms and conditions.
1. Services Agreement
Harshit Web Solutions provides a wide range of digital services. The specific scope of work, timelines, and deliverables for each project will be outlined in the individual service proposal or invoice provided to the client. Any modifications to the project scope after the commencement of work may incur additional charges.
2. Client Obligations
To ensure the successful completion of your project, the client agrees to:
Provide all necessary information, text, images, and login credentials (Shopify, Amazon, Email, etc.) in a timely manner.
Review and provide feedback on deliverables within the agreed timeframe.
Ensure that all materials provided to us do not infringe upon any third-party intellectual property rights.
3. Payment Terms
Project Initiation: A percentage of the total fee (as specified in the invoice) is required as a non-refundable deposit before work begins.
Milestone Payments: Payments are due upon the completion of specific project phases.
Late Payments: Failure to make payments on time may result in a temporary suspension of services or the removal of the website/store from live servers.
4. Third-Party Platforms (Amazon, Flipkart, Shopify, etc.)
Harshit Web Solutions acts as a consultant/manager for your accounts on third-party platforms.
We are not responsible for account suspensions, policy changes, or technical glitches caused by the platforms (e.g., Amazon, Shopify, Zomato).
Clients are responsible for complying with the respective platform's terms of service.
5. Intellectual Property
Upon full and final payment, the ownership of the final website or digital asset will be transferred to the client. However, Harshit Web Solutions retains the right to:
Display the project in our portfolio, case studies, and marketing materials.
Retain ownership of any pre-existing code, tools, or proprietary processes used during development.
6. Confidentiality
We respect your privacy. All business information, login data, and project details shared with Harshit Web Solutions will be kept strictly confidential and will not be shared with third parties without your prior consent.
7. Limitation of Liability
Harshit Web Solutions shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities, arising out of the use or inability to use our services.
8. Project Termination
Either party may terminate the agreement with written notice if the other party breaches the terms. In the event of termination, the client is responsible for paying for all work completed up to the date of termination.
9. Support and Maintenance
Post-launch support is provided for a specific period (as per your plan, e.g., 10 months for certain clients). Continuous maintenance or major updates after this period will be billed as a separate service or monthly retainer.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.
